Georgia’s Definition of Prostitution

According to the state of Georgia (O.C.G.A. 16-6-9), a person commits the crime of prostitution when he or she “performs or offers or consents to perform a sexual act, including but not limited to sexual intercourse or sodomy, for money or other items of value.”

To be convicted of prostitution, a person only needs to demonstrate that they intended to commit the crime. They do not need to actually go through with a sexual act, or even receive money. Merely offering to commit a sexual act in exchange for money or valuables is enough to be found guilty of prostitution.

Punishments for Prostitution in Georgia

The offense of prostitution is charged as a misdemeanor. It can result in a sentence of up to one year in jail and/or a fine of $1,000. The penalty increases if prostitution is committed within 1,000 feet of a place of worship, playground or recreation center primarily used by children under the age of 17. In that case, a fine of $2,500 will be added.
